Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Prime Path Lab, Inc. (“we,” “us,” or “the Laboratory”) is a CLIA-certified clinical laboratory and a covered entity under the Health Insurance Portability and Accountability Act (“HIPAA”). We are required by law to maintain the privacy of your protected health information (“PHI”), to provide you with this Notice of our legal duties and privacy practices, to notify affected individuals following a breach of unsecured PHI, and to abide by the terms of the Notice currently in effect.
How we may use and disclose your PHI
Treatment. We may use and disclose your PHI to perform laboratory testing ordered by your healthcare provider and to communicate results to the ordering provider and other clinicians involved in your care.
Payment. We may use and disclose your PHI to bill and obtain payment for laboratory services from you, your health plan, Medicare, Medicaid, or another payer, including for eligibility verification, prior authorization, and claims processing.
Health Care Operations. We may use and disclose your PHI for quality assessment, proficiency testing, accreditation, credentialing, compliance, auditing, and other operations necessary to run the Laboratory.
Uses and disclosures that may be made without your authorization
Consistent with applicable law, we may use or disclose your PHI without your authorization: as required by law; for public health activities, including reportable disease and specimen reporting; to health oversight agencies; in judicial or administrative proceedings; to law enforcement as permitted by law; to coroners, medical examiners, and funeral directors; for organ or tissue donation; for approved research under applicable safeguards; to avert a serious and imminent threat to health or safety; for specialized government functions; and for workers’ compensation as authorized by state law.
Uses and disclosures requiring your written authorization
Most uses and disclosures of PHI not described above will be made only with your written authorization, including any marketing communications and any sale of PHI. You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.
Your rights regarding your PHI
- Inspect and obtain a copy of your PHI, including an electronic copy where we maintain it electronically.
- Request that we amend PHI you believe is incorrect or incomplete.
- Receive an accounting of certain disclosures.
- Request restrictions on certain uses and disclosures. We must honor a request to restrict disclosure to a health plan for a service you paid for in full, out of pocket.
- Request confidential communications by alternative means or at an alternative location.
- Receive a paper copy of this Notice on request.
- Be notified following a breach of your unsecured PHI.
Our duties and your right to complain
We are required to protect your PHI, provide this Notice, and follow its terms. We reserve the right to change this Notice and to make the revised Notice effective for PHI we already maintain, as permitted by law. If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer at the contact below, or with the U.S. Department of Health and Human Services, Office for Civil Rights. You will not be retaliated against for filing a complaint.
Genetic information
Genetic information is protected as PHI under HIPAA and as sensitive data under Colorado law. We do not use or disclose genetic information for underwriting purposes, and we obtain separate consent where required before performing genetic testing.
